LEGAL MATTERSThe Website is a United States-based website and the Website and the Products and Services may be subject to the laws of various jurisdictions, including the laws of the United States and/or the European Union and other jurisdictions since the Access to the Website may use the internet infrastructure of different jurisdictions.
Optaris may be required by law enforcement or judicial authorities to provide personally identifiable information to the appropriate government authorities. If requested by law enforcement or judicial authorities, Optaris will provide this information upon receipt of the corresponding documentation. Optaris may also provide information to law enforcement to protect your property and the health and safety of individuals as permitted by statute.
Optaris may disclose your personally identifiable information without your permission if it has a good faith belief that disclosure is reasonably necessary to comply with any enforceable law, regulation, legal process or governmental request or to investigate or protect against harmful activities towards Optaris customers, to users, associates or property (including the Website) or others. Optaris also reserves the right to disclose such information to enforce the applicable Terms of Service, including the investigation of possible violations of the Terms of Service.
Third Party WebsitesThe Website may contain links to websites that are owned and operated by third parties. Such links are present for your convenience and information. Optaris does not control these third-party websites and is not responsible for their content or privacy practices. Optaris does not control the information collection and distribution policies on such websites except those under the control of Optaris. The content on third party websites may not reflect products, services or information provided by Optaris. Third parties may also set their own cookies and/or use web beacons (defined below), which may be used to identify some of your preferences or to recognize You if You have already contacted third parties. Optaris does not control the use of such technology by third parties, the information they collect, or how they use such information. You should direct all your concerns about any third-party Web site to the administrator of those sites.
Information we CollectedMost of the Products and Services offered to visitors to the Website require that You register a user account with Optaris ("User Account"). When registering for a User Account, Optaris will ask You to voluntarily provide certain information about yourself by completing and submitting an online form. Such information may include your first name, last name, telephone number, credit card or other billing information, email address and postal address of the company and individual; This information will be stored in AWS (Amazon Web Services). It is completely optional for You to register a User Account or participate in activities that require a User Account.
When ordering Products and Services through the Website, You may be required to provide a credit card number, an account, and/or billing and shipping information that enables the completion of the transaction. The information above is collected and processed by online payment services, including but not limited to business account services, which we may use for payment processing, including automatic subscription renewals. Also, as noted below, You are required to provide the minimum information if You choose to subscribe to product updates.
When You use the Website, Optaris or reliable third parties authorized by Optaris may also collect certain technical and routing information about your computer (also known as environment variables) to make it easier for You to use the Website and its services. When You browse the Internet, your Internet browser (such as Mozilla Firefox, Microsoft Internet Explorer, Google Chrome) automatically transmits certain information to Optaris each time You access content on one of our Internet domains. Examples of such information are the URL of the particular web page You visited, the IP (Internet Protocol) address of the computer You are using, or the browser version You are using to access the Website. All this information can be collected by Optaris and used to help improve our offer.
We use such information to facilitate and track your use of the Website and its services. Optaris also uses environment variables to measure traffic patterns on the Website, without expressly informing You in each particular circumstance, and without linking such information with your personal information.
You may be given the opportunity to subscribe to a regular newsletter and product updates. This newsletter is a marketing tool that allows Optaris to inform You about new Products and Services, updates and other news relevant to the company. The subscription service requires that you provide your first and last name, your email address, and other information. Optionally, You are asked to provide the name of the company You represent. You are given the opportunity to choose the type of information that Optaris will provide You and You will be given the opportunity to opt out of receiving such information by making an appropriate choice in your User Account or by writing to email@example.com.
When You submit personal information to Optaris through the Website, You understand and agree that this information may be transferred across international borders and may be stored and processed in any of the countries where Optaris has virtual servers (Optaris operates 100% of its infrastructure on AWS). You also acknowledge that in certain countries or with respect to certain activities, the collection, transfer, storage and processing of your information may be done by reliable Optaris providers. Such providers are contractually bound not to use your personal information for their own purposes or to provide it to third parties.
RecordsOptaris collects and stores the files that you upload, download or access through the Products and Services offered through the Website. We understand that these files may be confidential or contain confidential information. Consequently, Optaris does not share or allow third parties to access such files.
User AccountAs described above, you will be given the opportunity to create a User Account containing your personal information. A User account is required to use most of the Products and Services offered on the Website. Once the User account has been created, You will be able to access, review and update your information in the User Account online on the Website.
If You wish to deactivate your User Account, You can do so through the User Account interface or by contacting Optaris at firstname.lastname@example.org.
When You deactivate your User Account, all information stored and maintained as part of your account will be deleted from our servers, including files stored through the Website or its Products and Services. The archived backup of your data will be deleted during the next Optaris backup cycle.
If You create an account, then You have the right to access and change your personal information and privacy preferences at any time by logging into your User Account, where You can view and make changes to personal information. You can also access and change your personal information and privacy preferences by contacting us at email@example.com.
We work hard to protect Optaris and our clients from unauthorized access or alterations, unauthorized disclosure or destruction of information we hold. In particular:
- We encrypt our service using SSL.
- We actively and periodically review information collection, storage and processing practices, including physical security measures, to be protected from unauthorized access to our systems.

How Your Personal Information Is UsedOptaris collects your information to record and support your participation in the activities you select. We may use your email address to send a confirmation email and, if necessary, we may use other information You provide to contact You for assistance in processing the purchase or service You have selected. If You subscribe to a service or register a product, for example, such information is used to register your rights, if any, to technical support or other benefits that may be available to registered users. Unless you choose otherwise, your personal information may also be used to keep You informed about new products, product updates, patches, special offers and other Optaris Products and Services, if you have chosen to receive such communications.
Optaris may collect information about the use of the Website, such as types of services used and the number of users we receive on a daily basis. This information is collected together, without identifying any individual user. Optaris may use this set of non-identifiable statistical data for statistical analysis, marketing or similar promotional purposes.

If You choose to "opt out", we will not send You any emails. If Optaris sells assets (or the assets of a division or subsidiary) to another entity, or if Optaris (or a division or subsidiary) is acquired or merged with another entity, You agree that Optaris may provide such entity with customer information that is related to that part of our business that was sold or merged with the other entity without obtaining your additional consent.
